PHOTO, MEDIA, AND LIABILITY RELEASE
Photo & Media Release
I give Distill Creative my permission to take photographs and/or obtain audio or video recordings (“Media Materials”). Additionally, I authorize the use of the Media Materials, my likeness, personal characteristics, and information in connection with the Media Materials, according to the terms and conditions set forth in this Photo, Media, and Liability Release (“Release”).
1. Grant of Rights. I irrevocably grant Distill Creative permission to use my likeness from any Media Materials from Distill Creative activities in any of its printed and digital publications, online advertising or marketing campaigns, or other promotional materials including, but not limited to, social media, flyers, brochures, newsletters, emails, newspaper articles, TV or cable interviews/promotions.
2. Waiver of Rights.
2.1 Ownership. I waive and release any and all ownership rights in any Media Materials using my likeness, understanding that Distill Creative will become the sole and exclusive owner of the Media Materials, which will not be returned.
2.2 Compensation. I waive and release any rights to financial compensation for such Media Materials. I understand my participation is voluntary and for the intangible value I will gain from my involvement with Distill Creative activities, the receipt and sufficiency of which I hereby acknowledge.
2.3 Approval Rights. I waive the right to inspect or approve any finished product, including written or electronic copy, wherein my likeness appears.
2.4 Royalties. I waive any right to royalties or other compensation arising from or related to the use of the Media Materials.
3. No Right to Review. I irrevocably authorize Distill Creative and its affiliates, licensees, agents, and assigns ("Authorized Persons") to edit, alter, copy, exhibit, publish or distribute any Media Materials for the purpose of publicizing Distill Creative's workshops or for any other related, lawful purpose.
Liability Release
1. Release of Claims. I hereby hold harmless, release, and forever discharge Distill Creative from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf may have, resulting from this Release.
2. No Right to Relief. I waive my right to injunctive and other equitable relief in the event of a dispute with Distill Creative.
3. Irrevocability. I understand that Distill Creative is relying on this Release and will incur significant expenses in its reliance, therefore, I agree that this Release cannot be terminated, rescinded, or modified.
THIS RELEASE PROVIDES Distill Creative WITH MY ABSOLUTE AND UNCONDITIONAL CONSENT, WAIVER, AND RELEASE OF LIABILITY, AUTHORIZING Distill Creative TO USE MY LIKENESS, PERSONAL CHARACTERISTICS, AND INFORMATION IN CONNECTION WITH ANY PHOTOGRAPHS, AUDIO, OR VIDEO RECORDINGS, UNDER THE TERMS AND CONDITIONS SET OUT ABOVE. BY SIGNING, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS PHOTO, MEDIA, AND LIABILITY RELEASE AND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE Distill Creative.
